What the hell? I feel bad for having read the land now! Surely LitRPG is a descriptive term and can't be trademarked?
He's lucky this didn't go viral like KUgate. I wonder if he's watching that brouhaha and rethinking it.
I've got a few trademark attorney friends here in Australia. Some of them know a thing or 2 about US trademark law. I ran his all past them...here are a few responses: "The US registration in Class 41 is on the supplemental register - distinctive marks go on the principal register. "Owners of the registrations on the Supplemental Register are still permitted to sue for trademark infringement based upon their common law rights (if any), but must prove that the registered term actually functions as mark. Unlike a mark registered on the Principal Register, the Supplemental Registration provides no evidence of trademark rights in the registered term in a court proceeding." So unless they can prove they have a really big reputation and it functions as a TM through use rather than being seen as a descriptive term, it will be hard to enforce." "The class 25 registration won't be an issue unless your friend is selling clothing" So it may not be as bad as it seems, bit still a massive dick move.
It's kind of funny, but it was actually all of this nonsense that made me decide to actually decide to stop my other writing projects and prioritize my litRPG.
Yeah, between him banning me from his group and trying to ban me from Reddit, I don't think I can trust him with the trademark. Things are looking good, though.
I meant he was a mod of the Reddit for LitRPG for a while. He banned me while he was. The original guy that started the sub-reddit came back and reinstated my account.
Okay, I think I'm going to be involved with this push to revoke his trademark. I'm not sure if I can do it with my pseudonym or not yet. However, if I can't keep my identity secret, I'll reveal myself and give up my anonymity for the sake of the entire LitRPG community. We need more authors willing to put their name to this effort.
