Stopping the LitRPG Trademark...

Glad to see something is being done.

 

What the hell? I feel bad for having read the land now! Surely LitRPG is a descriptive term and can't be trademarked?

 

He's lucky this didn't go viral like KUgate. I wonder if he's watching that brouhaha and rethinking it.

 

It is a descriptive term, still got trademarked though

 

I've got a few trademark attorney friends here in Australia. Some of them know a thing or 2 about US trademark law. I ran his all past them...here are a few responses:

"The US registration in Class 41 is on the supplemental register - distinctive marks go on the principal register.

"Owners of the registrations on the Supplemental Register are still permitted to sue for trademark infringement based upon their common law rights (if any), but must prove that the registered term actually functions as mark. Unlike a mark registered on the Principal Register, the Supplemental Registration provides no evidence of trademark rights in the registered term in a court proceeding."

So unless they can prove they have a really big reputation and it functions as a TM through use rather than being seen as a descriptive term, it will be hard to enforce."

"The class 25 registration won't be an issue unless your friend is selling clothing"


So it may not be as bad as it seems, bit still a massive dick move.

 

It's kind of funny, but it was actually all of this nonsense that made me decide to actually decide to stop my other writing projects and prioritize my litRPG.

 

No one can stop Reddit. It’s as powerful a force as Facebook with much cooler owners.

 

Yeah, that's a total "seems trustworthy to me" act, right there. Ugh.

The more I heard about this, the less I tolerate it.
